    The case dates back to 2015 and raises many legal issues. The main concern was whether United Airlines had followed the applicable provisions of SS 226 in California’s Labor Code. This is California’s equivalent of the VPWL. Specifically, the question was whether United Airlines provided the required wage information to United Airlines flight attendants (Plaintiffs) through its various wage statements and documents.

    This was difficult because of the complicated way that Plaintiffs were paid. The Plaintiffs received two payments per “bid period” due to their collective bargaining agreements (CBAs). This lasted for about one month. The payment was based on an estimate of work volume and not hours worked by the flight attendant. The first payment was made on the first day of each month.

    Two weeks later, the second payment arrived. It consisted of actual earnings plus per diem, less the advance. You could calculate the exact earnings amount by subtracting the “minimum wage guarantee” and the “flying activity” of the flight attendants during the relevant period.

    The “flying activity” amount was calculated using several formulas. These formulae were then subject to adjustments based on variables such as seniority, responsibilities, time spent on a flight, language proficiency, and when they worked.

    Flight attendants were paid and received several documents that included their wage information. These documents could consist of:

    Both sides recently filed motions for summary judgment. United Airlines presented many arguments. However, the most important was that these wage documents were compliant with applicable portions of SS 226 of the California Labor Code.     The court sided with the Plaintiffs in their motion for summary judgment. It found that United Airlines had violated specific provisions under SS 226. The civil and statutory sanctions were to be determined at a later hearing.
